In the event that any official or employee fails or refuses to comply with any of the conditions set forth in CMC 2.55.060, or elects to provide his/her own representation with respect to any such claim or litigation, then all of the provisions of this chapter shall be inapplicable and shall have no force or effect with respect to any such claim or litigation.
